Legal Under "Fair Use" to use music in montages?

So with theater mode in MW3, I wanted to make a montage using "Another One Bites the Dust" by Queen and went to post my work on it so far to get some feedback from you folks and was told it was blocked by Warner Music Group for copyright infringement.

I'm not looking for a way to circumvent this to "trick" youtube into letting me post it. I am interested in whether or not it is legal to use a song that it not yours as part of a non-profit video made simply as a artistic venture.

Any lawyers in the house that can weigh in on this?

[MENTION=1797]TVA TEARDROP[/MENTION] was talking to me about this a little while ago. They are supposedly passing a law where if you dont get permission they can take legal action. For montages I dont see what the big deal is if you are advertising to buy it on iTunes for example :/

Musicians should be happy that we still play their music for them. I enjoy music every once in a while, but I can live with out it. I don't think I've spent a dime on any type of music within the last 5 years, that's why I have a radio in my car, and even then it's tuned to Sports Talk Radio LOL.

Well that's unfortunate. I had a minute done already and my Bouncing Betty kills fit perfectly into the song.

I'll probably end up finishing it anyway, but I was really hoping to get some feedback about it so far.

It depends on the label/ artist. They actually have a say as to what action gets taken on their intellectual property. Sometimes the audio will be full out removed and sometimes they will say just put a link to buy on itunes in. It all depends on the song. For example I made this: [ame=http://www.youtube.com/watch?v=OC26HlTVP94]Kife only Gun game... or Knife Game - Black Ops Gameplay - YouTube[/ame] and got lucky in that they stuck the itunes link on there but the song is also from warner music group

Yea it seems song specific.

For instance, mine said it I didn't have to remove the music or take any further action, but the video was blocked in the United States, and two other countries.

Which stinks because I've been planning a Another One Bites the Dust montage since the creation of Theater mode.

What you may consider is talking to one of our Eastern Mates here on IPC, such as [MENTION=19245]spank2103[/MENTION]. He may be able to host the video in his country and we may be able to see it, just a thought?
